Collecting and processing of personal data
Haibach & Cie. Gesellschaft für Personalberatung mbH stores and processes personal data for the fulfilment of service contracts on the basis of a consent given by the person concerned or on the basis of the following legal bases and in accordance with the applicable legal regulations of the GDPR and the BDSG.
The processing of personal data by Haibach & Cie. is part of the provision of services in the process of which Haibach & Cie. has received the relevant data of business relationships with customers, service providers and candidates. Haibach & Cie. also processes personal data that we have obtained and may process from publicly accessible sources such as the press and the Internet in a permissible manner.
Relevant personal data are personal data (name, address and other contact data, birthday and place of birth, nationality, professional background), data about your use of our website (see below) and other data comparable to the above categories.
This personal data can be processed for the following purposes: Application procedure of the person concerned as a job seeker; contacting in the case of relevant job filling procedures; conducting searches for potential candidates on behalf of clients who have a vacancy in the areas of specialists and managers; evaluating the suitability of a candidate for vacancies with clients; operating a database in which personal data and information on the persons/clients/candidates concerned are stored.
For the processing of personal data necessary for the performance of a contract to which the data subject is a party, the legal basis shall be Article 6(1)(b) GDPR. This also applies to processing operations that are necessary to carry out pre-contractual measures. If the processing of personal data is necessary to fulfil a legal obligation to which our company is subject, Article 6(1)(c) GDPR serves as the legal basis. If processing is necessary to safeguard a legitimate interest of our company or of a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first interest, Article 6(1)(f) GDPR shall serve as the legal basis for processing.
By sending applications or enquiries to us and providing your personal data as part of this process, you expressly consent to the processing of this personal data. This consent is also a legal basis for processing personal data in accordance with Article 6(1)(a) GDPR. You are not obliged to agree and can revoke a declaration of consent at any time with effect for the future. If you wish to exercise these rights, please contact our data protection officer.
When you visit our webpages, our web servers will store the following data by default:

The processing of the aforementioned data is carried out for the purpose of optimising and technically administering our website, consequently on the basis of a legitimate interest pursuant to Article 6 (1) (f) GDPR.

If you send us an e-mail to contact us, you consent to the processing of your submitted data (e.g. e-mail-adress, full name) for the purpose of answering your request and contacting you by Haibach & Cie. according to Article 6(1)(a) GDPR. This data will not be disclosed to third parties and will be deleted immediately after the contact has been made, provided that this does not result in any further use. Our website is hosted on a server in Germany at ALL-INKL.COM - Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf. The hoster stores the following data of the Access-/FTP-Logs for the purpose of technical aministration and optimisation of the website:
- IP-adress of your computer in abbreviated form (the last two digits of the IP address will be truncated)
- Browser type and browser version
- Time zone
- Command (e.g. GET)
- Object (file)
- Your computer‘s operating system
The processing of personal data is based on a legitimate interest within the meaning of Article 6(1)(f) GDPR.
These data is stored up to 30 days from the day the data is collected and is then deleted.
Use and disclosure of personal data and earmarking
Haibach & Cie. Gesellschaft für Personalberatung mbH uses your personal data for purposes of technical administration of the web pages only in the required amount. The transfer of personal data to state institutions and authorities will only be done within the framework of mandatory national legislation. Our employees are bound to confidentiality.
Your personal data will only be passed on or otherwise transmitted to the extent that this is necessary for the purpose of processing your application and the purposes and services of Haibach & Cie. described above and you have given your prior consent to this transfer. The possible recipients are only customers with whom Haibach & Cie. has a business relationship.

Expected duration of data use
Haibach & Cie. Gesellschaft für Personalberatung mbH uses and stores your data within the legally permitted or legally required duration and duration of a business relationship, which also includes, for example, the initiation or execution of a consulting mandate. The personal data of the person concerned will be deleted or blocked as soon as the purpose of storage ceases to apply. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract. The duration of storage may also depend on the statutory statute of limitations.

Our security measures are continously improved in line with technological developments.

According to GDPR you have a right to free information about your stored data as well as a right to correction, deletion, restriction of the processing or a right of objection against the processing of this data, as well as the right to data transferability.
